Boy, 13, forced to perform sex act on 30 year old man, court heard

The man pleaded guilty to defilement of a minor at Letterkenny Circuit Court

A 13-year-old boy was forced to perform a sex act on a 30-year-old man hours after downloading a gay dating app.

The boy was left at his Donegal, Ireland, home with his siblings after his mother went out for a couple of hours, leaving him her mobile phone in case he needed to get in touch with her.

He then downloaded the Gaydar app and on his profile he claimed to be 19, the Irish Examiner report.

A short time later, the man – who was 30 at the time – contacted him and was told his mother would be out for two hours.

The man then arranged to travel to his home after showering on April 13, 2015.

Police officer Malcolm Hooks told Letterkenny Circuit Court that while the Gaydar profile said he was 19, another part of the profile said: “I’m not a porn star, I’m a 13-year-old”.

Hooks then went on to say that when the boy was interviewed he claimed that he was forced to give oral sex to the man which was witnessed by his mother who came home unexpectedly.

The man admitted in a letter when he first saw the boy, he thought he was “16 or 17”.

During the court proceedings, the man’s sister revealed her family had no idea he was homosexual and she is “deeply ashamed” of what happened.

Colm Smyth, for the accused, said his client is from a “respectable family” who are all shocked by what happened.

In a report from a forensic clinical psychologist, they found the man to be “immature” and “introverted” and claimed he has difficulty recognising his bisexuality.

The psychologist added that he found no interest in paedophilia and the man told him: “I’m not that kind of person and I’m disgusted with myself.

“If I can fix this in any way, I will.”

The man pleaded guilty to the defilement of a child under the age of 15 years and the trial was adjourned so the judge could hear evidence from the boy.
